By using Summit Estate Management, LLC's property management platform (the "Service"), you agree to these Terms. If you are using the Service on behalf of an organization, you are agreeing on behalf of that organization and represent that you have authority to bind it.
You must be 18 or older. You must keep your login credentials confidential and enable multi-factor authentication if your role requires it. You are responsible for activity that occurs under your account.
You may use the Service only for legitimate property-management work. You may not:
You retain ownership of any photos, documents, notes, and other content you upload. You grant Summit Estate Management a non-exclusive license to host, display, and process that content as necessary to operate the Service for you.
The Service is provided "as is" without availability guarantees in v1. We aim for high uptime but do not commit to a contractual SLA at this stage. Planned maintenance is communicated in advance when possible.
Either party may terminate by written notice. On termination, you may request an export of your data via /account/data-export and a deletion of your account via /account/deletion-request. We will fulfill deletion within 45 days subject to legal retention requirements.
The Service is provided AS IS and AS AVAILABLE without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, in no event will Summit Estate Management, LLC or Oakwright be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our aggregate liability under these Terms will not exceed the amount paid by you for the Service in the 12 months preceding the claim, or one hundred US dollars, whichever is greater.
You agree to indemnify and hold harmless Summit Estate Management, LLC and Oakwright from claims arising from your violation of these Terms, your content, or your use of the Service in breach of applicable law.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Pitkin County, Colorado.
We may update these Terms. Material changes will be communicated by email or via the platform at least 14 days in advance.
